Terms of Service

AllByRent is a platform that connects item owners with renters. We provide the tools, payments infrastructure, and insurance — but we are not a party to any rental transaction between users.

1. Acceptance of Terms

By accessing or using AllByRent ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These Terms apply to all users, including owners who list items and renters who book them.

2. Eligibility

You must be at least 18 years old to use AllByRent. By creating an account, you confirm that you are 18 or older and legally capable of entering into binding agreements. Identity verification is required before listing items or completing high-value transactions.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate information and to update it when necessary. AllByRent reserves the right to suspend or terminate accounts that violate these Terms.

4. Listings and Transactions

Owners may list physical items for Rent, Sale, Rent to Own, or Gift. By creating a listing, you confirm that:

Renters agree to use items only for their intended purpose, return items in the same condition, and comply with any instructions provided by the owner.

5. Payments

All payments are processed through Stripe. AllByRent never stores credit card or bank account information directly. By using the Platform, you agree to Stripe's Terms of Service. Platform commission is deducted automatically from each transaction. Payouts to owners are processed via Stripe Connect, typically within 2 business days after transaction completion.

6. Insurance

Rental insurance is provided automatically through Safely API on all Rent and Rent to Own transactions. The insurance cost is included in the rental total and paid by the renter. Insurance covers the owner's item against damage or loss during the rental period. Coverage terms are subject to Safely's policies. AllByRent does not guarantee insurance outcomes and is not a party to insurance claims.

7. Security Deposits

Owners may optionally require a security deposit. Deposits are held as authorization holds via Stripe and are not charged unless damage is reported within 48 hours of item return. AllByRent provides transaction data to support deposit claims but does not adjudicate disputes between users.

8. Platform Neutrality

AllByRent is infrastructure, not a mediator. The Platform facilitates transactions and provides data — including transaction records, QR scan timestamps, photos, and messages — to both parties and to third-party services such as Safely API. AllByRent does not take sides in disputes, does not employ human agents for dispute resolution, and cannot be held liable for outcomes between users.

10. QR Codes and Tracking

Each listed item may receive a unique QR code. QR scan events (pickup and return confirmations) are timestamped and stored. These records serve as evidence in disputes and insurance claims. Users consent to the collection of these scan events as part of using the Platform.

11. Reviews

After each completed transaction, both parties may leave reviews. Reviews are subject to a blind review process — neither party sees the other's review until both have submitted, or until 48 hours have passed. AllByRent reserves the right to remove reviews that violate community guidelines, contain false information, or constitute harassment.

12. Cancellations and Refunds

Cancellation and refund policies vary by listing type and timing. Owners set booking confirmation modes (Instant or Manual). In Manual mode, owners must respond within 24 hours or the booking is auto-cancelled with a full refund. No-shows are subject to a no-show fee equal to one daily rate. AllByRent reserves the right to issue refunds in cases of documented fraud or platform error.

13. Intellectual Property

AllByRent and its content, including but not limited to the AllByRent name, logo, Mr. Rentano character, and Platform design, are owned by AllByRent and protected by intellectual property laws. Users retain ownership of content they upload (photos, descriptions) and grant AllByRent a license to display that content on the Platform.

14. Limitation of Liability

To the maximum extent permitted by law, AllByRent shall not be liable for: any indirect, incidental, or consequential damages; loss of items, profits, or data; or any outcomes arising from transactions between users. The Platform is provided "as is" without warranties of any kind. Our total liability to any user shall not exceed the fees paid to AllByRent in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify and hold AllByRent harmless from any claims, losses, or damages arising from your use of the Platform, your listings, your rental activities, or your violation of these Terms.

16. Governing Law

These Terms are governed by the laws of the State of Arkansas, United States, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in Hot Springs Village, Arkansas, except where prohibited by law.

17. Changes to Terms

AllByRent reserves the right to update these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
